Dear Perspective Buyer:
William J. Tucker, Inc. (“Receiver”) in its capacity as Receiver of 801-825 Broad Ripple Avenue, Indianapolis, Indiana 46220 (the “Real Estate”) is presently accepting Offers (as further defined herein) for the purchase of the Real Estate. The marketing brochure (the “Marketing Brochure”), which contains information related to the Real Estate, is available below. It is in 5 parts, due to it's large size.
The Receiver will receive offers for the purchase of the Real Estate through the close of business on February 8, 2010 (the “Offers”) in the form of the purchase agreement (the “Purchase Agreement”) which is located in Section 10 of the Marketing Brochure. All Offers must be delivered to and in the Receiver’s possession by the close of business on February 8, 2010.
As provided for in the Purchase Agreement (to be used to make an Offer), the buyer and seller shall each be responsible for payment of their own finders’, consultants’, and brokers’ fees.
The Receiver shall respond to any Offer to purchase the Real Estate by accepting the Offer, rejecting the Offer, or by making a counteroffer. In the alternative, the Receiver may further negotiate any Offer.
Upon acceptance of any Offer to purchase the Real Estate, as provided in Paragraph 7 of the Purchase Agreement, the Receiver shall seek authority from the Court establishing the receivership of the Real Estate to proceed with the sale of the Real Estate. The acceptance of any Offer is subject to approval of the Court as also provided in Paragraph 7 of the Purchase Agreement.
